WOWMELIVE LLC, which operates its business under than name and style of FITNESSKRIYA including its domain, fitnesskriya.com ("FITNESSKRIYA", "We", or "Us") acknowledges the importance to protect the privacy of any and every person or an entity that has agreed to be bound by “FITNESSKRIYA terms of use”, including (i) User, trial User (ii) Teachers, and (iii) Enterprise that purchases or otherwise register for access to the Service. Please read this Privacy Policy carefully prior to using the Website, App or Service to comprehend our policies and practices regarding the treatment of your information. By accessing and using the Services you consent to our collection, storage, use and disclosure of your Personal Information and other information as described in this Privacy Policy and agree to be bound by the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not provide any Personal Information to us and do not access Website, App or Service(s) for any purpose.

When You access the Website, App or use the Service, whether as a Teacher or User or if you access for trials, a Trial User, we collect both Personal Information and Anonymous Information from and about our Users.

“Personal Information” is such data or information that can be used to contact or identify you, or other individuals about whom you enter information to avail of our Services, including, but not limited to first name, last name, e-mail address, phone number, street address, location, username, e-mail address in combination with a password or security questions and answers, credit/debit card information and personal pictures/images/video.

“Anonymous Information” is such data or information that cannot reasonably be used to contact or identify you and is not linked to information that can be used to do so. It includes passively collected information about your activities on the Services such as usage data, to the extent that information is not linked to your Personal Information, including but not limited to information about your gender and/or age, Information about the equipment you use to access the Website, App or Service, mobile device information, including mobile network and information collected through cookies and other tracking technologies.

·      Information you provide when commenting, reviewing, or communicating with others through the Service, including User Contributions (as defined below);

·      Your responses to surveys that we conduct for research purposes;

·      Information related to transactions you conduct through Website, App or Service and the fulfillment of your orders;

·      Your search queries on the Site.

You may also provide information, comments, reviews, images, videos, and other content, including but not limited to all forms of digital media and text, to be published or displayed on public areas of the Website or App or transmitted to other users or third parties (collectively referred to as "User Contributions"). ·      Recordings of Personalized Training Sessions: We only and exclusively record the audio of the User or if you access for trials, a Trial User, whereas we record both, audio and video for the Teacher (further detail hereunder in this Privacy Policy);

·      Other digital information gathered during group and personalized training sessions conducted through the Service, including, but not limited to chat messages, chat logs, and video/audio recordings, may also be collected.

Recordings of Training Sessions:

The Service allows for real-time interaction between Teacher, User or if you access for trials, a Trial User, in private, one-to-one sessions. These Training sessions are recorded for specific purposes ("Session Recordings"), which are further described and explained in this Privacy Policy. By participating in Training sessions through the Service, you expressly consent to and to the subsequent use and disclosure of such recordings in accordance with the details provided herein:

·      AUDIO/VOICE recording if you are a User or if you access for trials, a Trial User (receiver of the training Service(s))

·      AUDIO/VOICE and VIDEO if you are a Teacher

Subject to the limitations, restrictions, and licenses outlined in the “FITNESSKRIYA terms of use”, Recordings of all Sessions and Service(s) are owned by WOWMELIVE and stored for a period of 2 (two) years from the session date. However, WOWMELIVE, its Teachers, employees, and authorized personnel may access, store, view, disclose, and utilize the Recordings of any Private Session in which you participate for the following purposes: (i) planning and providing training to you, (ii) conducting Teacher training, quality assurance, customer service, and support programs (iii) for reference and resolution of any dispute and (iv) any other purposes to which you provide consent. FITNESSKRIYA will not disclose the Recordings of Private Sessions to other User or if you access for trials, a Trial User or Teachers, except for the Teacher conducting the Private Session and other Teachers with whom you collaborate (including, but not limited to substitute and replacement Teachers).

Please be aware that it is your responsibility to ensure that the microphone on your device used for Recordings, if you are the receiver of Service(s) or camera and microphone if you are a Teacher, does not capture or display any other sound, video or image besides yourself, including your children. We are not liable for any video, audio, or personal information collected through such Recordings of other individuals present in your vicinity during a Training session. 

Third-Party Use of Cookies and Other Tracking Technologies:

Certain content or applications on the Website, App are provided by third parties, including, but not limited to content and application providers. These third parties may use cookies, web beacons, or other tracking technologies to collect information about your usage of our Site. The information collected may be associated with your personal information, or they may collect information, including, but not limited to personal information, about your online activities across different websites and online services. We do not have control over these third parties' tracking technologies or how they use the collected information. How We Use Your Information:

Please note that FITNESSKRIYA reserves the right to manage its Teachers' accounts on various social media platforms, such as Instagram, Pinterest, and Twitter, for advertising, promotion, marketing, and account management purposes. Use of Anonymized data:

Notwithstanding anything else in this Privacy Policy, we may create anonymized and/or aggregated data ("Anonymized Data") that does not identify you using your information and may process, use, disclose, and share any such Anonymized Data with third parties without any restrictions. By using our services, you provide your consent to our ownership, generation, processing, use, sharing, and disclosure of any such Anonymized Data.

Security:

FITNESSKRIYA takes the security of your personal information seriously and implements reasonable measures to protect it from accidental loss and unauthorized access, use, alteration, and disclosure. However, the safety and security of your information also rely on your actions.
